Specializing in the National Interest Waiver (“NIW”)
A NIW petition allows you to apply for a green card. You must show that your work will benefit the U.S. national interest. The labor certification and job offer requirement are waived.
National Interest Waiver Requirements and Additional Criteria
The NIW applicant must meet the following requirements:
(1) hold an advance degree or its equivalent; or
(2) prove “exceptional ability”; and
(3) you must show that you plan on working in the U.S. in an area of substantial intrinsic merit;
(4) you must also show that the proposed impact of your work is national in scope; and
(5) you must show that waiving the labor certification requirement would benefit the national interests of the U.S.
NIW Additional Criteria
In addition to the NIW requirements, you must also meet at least three of the criteria below:
Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
Letters documenting at least 10 years of full-time experience in your occupation
A license to practice your profession or certification for your profession
Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability Membership in a professional association(s)
Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations
Other comparable evidence of eligibility is also acceptable
