OVERVIEW of K-1 FIANCE VISA
Now that you are engaged, and ready to build your future together in the U.S., you will need to understand the immigration process and what to expect over the next few months. A K-1 fiance visa is a temporary visa that allows your fiance to enter the United States for 90 days so that your marriage ceremony can take place. Once you marry, your spouse may apply for legal permanent residence and remain in the United States while USCIS processes the application.

The four general K-1 fiance visa requirements are as follows:
1. The petitioner must be a U.S. citizen.
2. The petitioner and fiance must intend to marry within 90 days of the fiance entering the U.S.
3. Both the petitioner and the fiance must be legally free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
4. The petitioner and fiance must have met in-person within the last two years.
There are two exceptions that require a waiver if the fourth requirement cannot be established: (1) if the requirement to meet would violate strict and long-established customs of your or your fiance’s foreign culture or social practice; and or, (2) if you prove that the requirement to meet would result in extreme hardship to you.

The fiancé visa process is made up of 2 main steps, and in total takes about 7-12 months from filing the initial case until your fiance’s visa is approved at the consulate.
Step 1: I-129F Fiancé Visa Petition
The I-129F, Petition for Alien Fiancé is filed the United States Citizenship and Immigration Services. The purpose of the petition is to validate the relationship between you and your fiancé. Since every relationship is different, every case is determined on a case-by-case basis. We will work with you to prove that your relationship with your fiancé is legitimate, and that you meet all other requirements to bring a fiancé to the U.S.
Step 2: Consular Processing
Upon approval of the K-1 fiance petition, your case will be forwarded to the U.S. Embassy/Consulate closest to your fiancé. Each consulate has specific processing instructions, so it is important that both the petitioner and fiancé follow all guidelines and meet all deadlines. Your fiancé will need to complete an interview and pass a medical exam as part of the fiancé visa process. We will help you prepare for this as a couple.
